Article 1 - Purpose
1a : These general conditions of service apply, without restriction or reservation, to any request for transport made with Atlas Business Courrier.
1b : The fact, for a natural or legal person, of requesting transport implies full acceptance of these general conditions of service. These are available at any time on www.abcourrier.be/general-conditions/ or on request. They will prevail, if necessary, over all other versions and over the client's general conditions of purchases or others.
1c : These general conditions may be waived only by the written agreement of Atlas Business Courrier. Any waiver granted by Atlas Business Courrier of the general conditions does not invalidate these general conditions.
Article 2 - Offer
2a : The validity period of our offers is one month.
2b : The price offer is the price that will be charged to the customer for the services indicated in the offer, with the exception of any fees (toll, customs duty, etc.)
Article 3 - Performance of services
3a : Atlas Business Courrier is committed to doing everything possible to offer its customers a high quality of service. Atlas Business Courrier is entitled to have the services ordered carried out by any collaborator or subcontractor of its choice, under its common law responsibility.
3b : Unless in case of express guarantee given to the customer, the collection and delivery will be made within 3 hours of the latter's call, in zones 1 & 2, except in cases of force majeure.
3c : The following are considered as force majeure, including but not limited to : Traffic accidents, fires, protests, strikes, riots, attacks and the direct or indirect consequences of these events. Our liability can only be incurred if the delay can be attributed to us.
3d : Atlas Business Courrier reserves the right to refuse to honour collection and delivery for a customer who has not fully or partially paid a previous invoice or with whom a payment dispute is pending.
Article 4 - Price
4a : All our prices are in euros, and are VAT-inclusive.
4b : Any VAT increase or new tax that may be imposed between the time of the provision of services and billing will be borne by the customer.
Article 5 - Cash on Delivery
5a : Cash on delivery will only be accepted after written agreement between the parties. Payments will only be processed in euros.
Article 6 - Customs and other charges
6a : The collection and delivery do not include the completion of customs formalities and associated costs. All these formalities and/or payments will be made exclusively by Atlas Business Courrier in full and at the risk of the customer, who will reimburse said costs plus waiting time.
Article 7 – Payment
7a : Our invoices are payable in full to the account of Atlas Business Courrier (IBAN : (BE31 0689 3103 7955), BIC : (GKCCBEBB)).
7b : Any late payment of more than fifteen (15) calendar days will result in an increase, ipso jure and without prior notice of 12% per annum, plus a fixed and irreducible compensation of 18%, with a minimum payment of €75,00. In addition, Atlas Business Courrier will be entitled to suspend its services as long as the customer remains in default of payment.
7c : In addition to this interest, the sum of our invoices may also be increased by €12.50 per mail sent and €25.00 for any person's travel. The legal costs and any defence fees will be borne by the debtor.
7d : Any dispute, to be admissible, must be notified, within a week, by registered mail upon receipt of the invoice. A change of address may not excuse not having knowledge of the invoice or not having disputed it in time.
Article 8 - Guarantees and limitations of liability
8a : If a customer considers that he is entitled to challenge the quality of the services provided by Atlas Business Courrier, he must, at the risk of being rejected, do so in writing (email, fax or postal mail), at latest, fifteen (15) calendar days following the transport of the parcel(s).
8b : Upon delivery being made and accepted, Atlas Business Courrier will no longer assume any liability.
Article 9 - Jurisdiction
9a : In case of dispute, only the courts of our jurisdiction are competent.
9b : The offer concluded between Atlas Business Courrier and the customer is subject to Belgian law.
Article 10 - Nullity
10a : The partial or complete nullity of one of the clauses of these general conditions does not affect the validity of the other clauses.
